The Protection of Personal Information Act 4 of 2013 (“POPIA”) has been in the works for over 14 years and it is finally at our doorstep.  The newly appointed Information Regulator is making steady progress towards POPIA becoming full effective, which might occur early 2018. Organisations will then have 12 months to become fully compliant.
POPIA impacts every industry and every organisation that processes personal information.  It is therefore imperative that organisations understand their obligations as set out in POPIA and implement appropriate measures, which also take into account the competitive, economic, labour and reputational issues that arise when dealing with personal data.
In addition, the new EU General Data Protection Regulation (“GDPR”) is set to become effective on 25 May 2018 and will also potentially affect organisations in South Africa due to its broad and extra-territorial scope. It is now time for all concerned organisations to understand their obligations under both POPIA and GDPR, and determine the most effective strategy for compliance.

ABOUT THE SPEAKER
> Lucien Pierce, founder and director of Phukubje Pierce Masithela Attorneys (PPM attorneys).
PPM attorneys is a boutique commercial law firm focusing on commercial, regulatory and compliance aspects of ICT and information security and data protection. Lucien has been involved in media and technology law for 20 years. In his current position, he is responsible for representing clients on the commercial, regulatory and compliance aspects of information and communication technology, information security and data protection law. Prior to joining PPM Attorneys, Lucien worked at Webber Wentzel, where he was responsible for advising clients on telecommunications, data protection and privacy law issues. Before that, he worked at the London law firm Bird & Bird and global telecommunications company Cable & Wireless. Lucien sits on the Disciplinary Committee of South Africa’s Independent Regulatory Board for Auditors, is a Board member of the International Social Media Association, and is a member of the Law Society of South Africa’s DIGITAL LEADers advisory group. Lucien earned B.Com and LLB degrees from University of Durban-Westville, and an LLM in IT and Telecommunications from University of Strathclyde in Scotland. He is admitted as an attorney of the High Court of South Africa.
